Holmes’ attorney, Jonathan Wolfe, told the publication: "This is a personal and private matter for Katie and her family…Katie's primary concern remains, as it always has been, her daughter's best interest."
Tom, 49, and Katie, 33, got married at an Italian castle in November 2006. They have one daughter together, Suri, age 6.

This was Katie’s first marriage and Tom’s third. He was previously married to actresses Nicole Kidman and Mimi Rogers. Cruise has two children with Kidman.
